Australian Freight Logistics Platform

By accessing or using the FreightOrbit platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. FreightOrbit reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
The Platform supports multiple user roles: Sender, Broker, Carrier, Driver, and Admin. Each role provides access to specific features and dashboards tailored to that function. You must provide accurate, current, and complete information during registration and keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Carriers must complete identity verification, including ABN validation and insurance documentation, before placing bids. Drivers must be assigned by a verified Carrier account. Brokers act on behalf of their clients and are responsible for the accuracy of job postings submitted under their account.
Senders and Brokers may post freight job listings describing the goods, pickup and delivery locations, dates, and budget. All listings must be accurate and complete. Carriers may submit bids on available jobs. Acceptance of a bid creates a binding agreement between the parties to complete the shipment under the specified terms.
FreightOrbit does not guarantee the availability of bids for any listing, nor does it guarantee that a Sender will accept any bid.
All payments are processed through Stripe. When a bid is accepted, the agreed amount is held in escrow until the shipment is confirmed as delivered. Funds are released to the Carrier after the Sender confirms delivery or after the 48-hour dispute window closes without a dispute being raised.
Carriers using the Platform must maintain an active Stripe Connect account. Platform fees and commission rates are disclosed at the time of bid acceptance and are non-refundable once services are rendered.
Either party may raise a dispute within 48 hours of delivery confirmation. Disputes are reviewed by the FreightOrbit team. During a dispute, escrowed funds are held until a resolution is reached. FreightOrbit may request supporting evidence including proof of delivery photos, GPS records, and communication logs.
FreightOrbit's decision on disputes is final and binding. In cases of fraudulent activity, accounts may be suspended or terminated immediately.
Jobs may be cancelled by the Sender before a bid is accepted at no cost. Once a bid is accepted, cancellation by the Sender may incur a cancellation fee of up to 15% of the agreed amount to compensate the Carrier for preparation costs. Carriers who cancel accepted jobs without valid cause may receive a strike under the Platform's 3-strike quality system.
Repeated cancellations by either party may result in account restrictions or suspension.
Carriers may subscribe to paid plans (Starter, Pro, or Enterprise) to access additional features including increased bid limits, priority placement, analytics, and driver management tools. Subscriptions are billed monthly. You may upgrade, downgrade, or cancel your subscription at any time. Changes take effect at the start of the next billing cycle.
FreightOrbit is a marketplace platform that connects Senders with Carriers. We do not own, operate, or insure any vehicles or freight. FreightOrbit is not liable for loss, damage, delay, or theft of goods during transit. Carriers are solely responsible for the safe transport of freight and must maintain appropriate insurance coverage.
To the maximum extent permitted by Australian law, FreightOrbit's total liability for any claim arising from your use of the Platform is limited to the fees paid by you to FreightOrbit in the 12 months preceding the claim.
You must not use the Platform to transport prohibited goods including illegal substances, hazardous materials without proper certification, stolen property, or any goods that violate Australian law. You must not engage in fraudulent activity, circumvent Platform fees, or misrepresent your identity, qualifications, or capabilities.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
FreightOrbit may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or failure to maintain required verifications. Upon termination, any pending escrow payments will be handled according to the dispute resolution process. You may delete your account at any time through your account settings, subject to the completion of any outstanding transactions.
These Terms are governed by the laws of the Commonwealth of Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
